Terms of Service

These terms govern your use of bkfiber.com and, where you are a customer, your use of internet service provided by Brooklyn Fiber ("Brooklyn Fiber," "we," "us," or "our"). By using this site or our service, you agree to these terms. If you do not agree, please do not use the site or the service.
Business, dedicated internet access, event, and property level services may be governed by a separate signed agreement. Where that agreement conflicts with these terms, the signed agreement controls.
Service
We provide internet access over a network we build and operate, combining a licensed millimeter wave backbone with fiber and ethernet distribution inside buildings. Availability depends on whether your building is on our network. Advertised speeds are the capacity of the connection we deliver to your unit or premises. Actual speeds you experience can vary with your equipment, in home wiring, wireless conditions, and the performance of destinations on the wider internet.
Pricing and no price creep
Plan pricing is published on this site. The plan price you sign up on is the plan price you keep. We do not use promotional rates that expire into higher rates, and we do not raise the price of your plan for as long as you keep it. There is no installation fee, no contract, and no cancellation fee on our standard plans. The plan price includes taxes and fees: the price we advertise is the price on your invoice.
Equipment
In buildings where we install a router or modem inside your unit, a refundable equipment deposit applies at activation. The equipment remains our property. It is refunded when the equipment is returned in working condition after service ends. You are responsible for equipment that is lost or damaged beyond normal wear. In buildings with managed building wide WiFi, no in unit equipment or deposit is required.
Installation and access
For installations that require a technician, you agree to provide safe access to the premises and to obtain any permission needed from a property owner or manager. We are not responsible for delays caused by building access, existing wiring, or third parties.
Acceptable use
You agree not to use the service to:
- Violate any applicable law or infringe anyone's intellectual property rights.
- Send unsolicited bulk email or operate open relays or proxies used for abuse.
- Attack, scan, or attempt to gain unauthorized access to any network, system, or account.
- Distribute malware or run services designed to disrupt other users of the network.
- Resell the service without our written agreement.
We may suspend service to address a security threat, an ongoing attack, or activity that materially degrades the network for other customers. We will restore service once the issue is resolved.
Network management
We are a net neutral, fully symmetrical internet service provider. We do not block lawful content, throttle lawful traffic based on its source or type, or accept payment to prioritize one company's traffic over another's. We monitor the network to keep it healthy and to detect abuse and security threats.
Billing
Service is billed monthly in advance unless your agreement says otherwise. Payment is due on the date shown on your invoice. If an account goes unpaid, we may suspend service after notice and may reinstate it once the balance is settled. Questions about a charge should go to [email protected] or 718-BKFIBER.
Cancellation
You may cancel at any time. There is no cancellation fee on standard plans. Cancellation takes effect at the end of the current billing period. Return any equipment we installed to receive your deposit back.
Support and uptime
We monitor the network around the clock. Our network has delivered 99.9% aggregate uptime; that figure is a measurement across our network, not a guarantee. Support is available 24 hours a day at 718-BKFIBER. Standard residential and small business plans are provided without a contractual service level agreement. Dedicated internet access customers receive service level commitments in their signed agreement.
Website content
The content on bkfiber.com, including text, layout, logos, and images, belongs to Brooklyn Fiber or its licensors. You may not copy or reuse it for commercial purposes without permission. Building availability shown on this site reflects our records at the time of publication and is not a guarantee that service can be delivered to a specific unit until we confirm it.
Disclaimers
Except as expressly stated in these terms or in a signed agreement, the service and this website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that service will be uninterrupted or error free.
Limitation of liability
To the fullest extent permitted by law, Brooklyn Fiber is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of your use of the service or this website. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim. Some jurisdictions do not allow these limits, in which case they apply to the maximum extent permitted.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the date at the top of the page. Continued use of the service after a change takes effect means you accept the updated terms. Material changes will be communicated to active customers.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Kings County, New York, and you and Brooklyn Fiber consent to that jurisdiction.
